How to Treat Heartburn without Drugs - Tips on Healthy Living

Posted on January 29, 2013

Are Your Prescriptions Killing You, heartburn, ZantacIf you?re bothered by heartburn or occasional acid reflux, it?s far more effective and safe to make some lifestyle changes than to rely on medications?some of which don?t even work! Start with this to-do list from Are Your Prescriptions Killing You? by Armon B. Neel, Jr., PharmD, CGP and Bill Hogan.

  • If you smoke, quit.
  • If you?re overweight, shed some of your excess poundage.
  • Avoid spicy, fatty, or fried foods, along with garlic, onions, citrus fruits, and any other foods that seem to trigger heartburn, such as tomato-based products.
  • Avoid caffeine and chocolate.
  • Avoid carbonated drinks and citrus juices.
  • Limit your consumption of alcohol to no more than two ounces a day.
  • Eat small meals.
  • Eat more fiber.
  • Consume nonfat or low-fat yogurt or cultured buttermilk throughout the day, every day, and always at bedtime.
  • Chew sugar-free gum after meals. It increases peristalsis, the symmetrical contraction and relaxation of stomach muscles, and helps move acid through the gut.
  • Don?t wear tight belts or clothing that?s tight around the waist.
  • Don?t bend over or exercise immediately after eating.
  • Eat at least three hours before your bedtime, and eat even earlier if you can.
  • Elevate the head of your bed.

If these suggested changes seem too overwhelming, you may want to focus on the two interventions that studies show to be most effective: losing some weight and raising the head of your bed. If you still need relief, use one of the newer over-the-counter H2 blockers such as Zantac for relief?but only on an occasional basis and in a dose of no more than 75 milligrams a day.

Healthy Church Challenge Tackles Obesity Epidemic - Memphis ...

VOL. 128 | NO. 20 | Wednesday, January 30, 2013

By MICHAEL WADDELL

Updated 2:20PM

BlueCross BlueShield of Tennessee?s second annual Healthy Church Challenge 100-day weight loss competition for churches in West Tennessee is set to get under way on Saturday, Feb. 2.

This year?s challenge is anticipated to include more than 50 local churches that will get the chance to compete for cash prizes to benefit their churches and health ministries.

?The idea for the Healthy Church Challenge came about from our foundation and company goal of impacting the health of the population in Tennessee,? said Calvin Anderson, senior vice president and chief of staff at BlueCross. ?Obesity is a lead driver of diseases such as hypertension and diabetes.?

This year?s grand prize will be a $5,000 certificate for fitness equipment and nutritional counseling, and there also will be an individual prize awarded to the person who loses the most weight overall. Last year, 458 men, women and children lost a total of 2,821 pounds. Fullview Missionary Baptist Church in Bartlett won first place, which included a $5,000 gift certificate to the Sports Authority and nutritional counseling from Baptist Memorial Health Care.

The 2013 Healthy Church Challenge is part of a city- and state-wide effort for citizens to reduce weight and live healthier. Memphis and Shelby County rank in the bottom 10 percent of some studies as it relates to health, healthy eating, exercise, healthy living, life-altering disease management and prevention. The 100-day Healthy Church Challenge is designed to address the problems through area faith-based organizations and create a healthier place to live, work and play in Memphis, Shelby County and West Tennessee.

?Memphis is the focus city in the state for 2012 and 2013; however, we are looking to expand to additional cities after we analyze the findings and results of this initiative,? Anderson said.

Tennessee also ranks sixth in the nation for childhood obesity and receives an ?F? on the national ?Report Card: State Efforts to Control Childhood Obesity.? Roughly one-third of all school children in the Mid-South are overweight or obese, and as many as two-thirds of adult Tennesseans are considered obese or overweight.

Earlier this month the Tennessee Commissioner of Health Dr. John Dreyzehner and his health policy team visited Memphis and talked to a group at the University of Memphis about the overall lack of physical activity in the state and how sedentary lifestyles can negatively impact health.

?If you look at the rankings, it is the area that we are currently as a state, relative to other states, doing the worst. We are ranked 48th,? Dreyzehner said.

Anderson expects the 2013 Healthy Church Challenge to grow this year, with participation expected from an estimated 50 churches following 36 last year. The event is open to all churches in West Tennessee and limited to 100 participants per church.

A mandatory weigh-in will take place at the Family Life Center at 70 N. Bellevue Blvd. starting at 10 a.m. and will run until 4 p.m. Alternate weigh-ins will take place Feb. 4 through Feb. 8, and then there will be a variety of ongoing activities including regular workout sessions and weigh-ins until late May. The challenge will culminate with an Obesity Summit and awards presentation on June 1. The full schedule, as well as daily tips for healthier living, can be found on the Healthy Church Challenge Facebook page.

At Saturday?s opening event, a workout session will be led by Yusuf Boyd, founder of Memphis-based BIOMechaniks, a boutique health/wellness studio, athletic performance, and injury prevention/rehabilitation service in Germantown. A nutritionist from The Regional Medical Center at Memphis also will teach participants the basics for healthy eating.

There will also be giveaways and vendors to disseminate health care information and products.

Entertainment is scheduled to include national gospel recording artist Darrel Petties, pastor of Mt. Pisgah Baptist Church in Memphis.

Skin, soft tissue infections succumb to blue light

Jan. 28, 2013 ? Blue light can selectively eradicate Pseudomonas aeruginosa infections of the skin and soft tissues, while preserving the outermost layer of skin, according to a proof-of-principle study led by Michael R. Hamblin of the Massachusetts General Hospital, and the Harvard Medical School, Boston.

The research is published online ahead of print in the journal Antimicrobial Agents and Chemotherapy.

"Blue light is a potential non-toxic, non-antibiotic approach for treating skin and soft tissue infections, especially those caused by antibiotic resistant pathogens," says Hamblin.

In the study, animal models were infected with P. aeruginosa. All of the animals in the group treated with blue light survived, while in the control, 82 percent (9 out of 11) of the animals died.

Skin and soft tissue infections are the second most common bacterial infections encountered in clinical practice, and represent the most common infection presentation -- more than 3 percent -- in patients visiting emergency departments, says Hamblin. The prevalence of skin and soft tissue infections among hospitalized patients is 10 percent, with approximately 14.2 million ambulatory care visits every year and an annual associated medical cost of almost $24 billion (equivalent to $76 for every American), says Hamblin.

Treatment of skin and soft tissue infections has been significantly complicated by the explosion of antibiotic resistance, which may bring an end to what medical scientists refer to as the antibiotic era, says Hamblin. "Microbes replicate very rapidly, and a mutation that helps a microbe survive in the presence of an antibiotic drug will quickly predominate throughout the microbial population. Recently, a dangerous new enzyme, NDM-1, that makes some bacteria resistant to almost all antibiotics available has been found in the United States. Many physicians are concerned that several infections soon may be untreatable."

Besides harming public health, antibiotic resistance boosts health care costs. "Treating resistant skin and soft tissue infections often requires the use of more expensive, or more toxic drugs, and can result in longer hospital stays for infected patients," says Hamblin.

Arrests along US borders up in last year

(AP) ? A year after Border Patrol apprehensions of illegal border crossers plunged to the lowest levels in nearly 40 years agents have seen a slight increase in arrests, according to Border Patrol arrest data obtained by The Associated Press.

In the budget year that ended in September, Border Patrol agents arrested 356,873 would-be border crossers along the Mexican border. In fiscal year 2011, agents along the Mexican border made 327,577 arrests.

According to the arrest statistics, agents in three Border Patrol sectors in Texas and the Yuma, Ariz., sector all made more arrests in the last year. Arrests in other sectors were down compared to a year ago.

Customs and Border Protection said in a statement that apprehensions remain at "historic lows" and pointed to continued decreases in arrests in California, New Mexico and most of Arizona as evidence that fewer people are crossing the border illegally.

In the Rio Grande Valley, illegal border crossers from countries other than Mexico made up the majority of the increase in arrests, the Border Patrol has said previously. Most of those people made their way to the border from Central American countries including Guatemala, El Salvador and Honduras.

That portion of the Texas-Mexico border is the shortest distance from Central America.

The numbers of Guatemalans passing through the area increased so much recently that the country opened a consulate in McAllen, Texas. Guatemala's consul there, Alba Caceres, said that Honduras or El Salvador might share their office space this year.

Nationwide, arrests by the Border Patrol increased by about 7 percent from 340,252 in fiscal 2011 to 364,768 last year. Despite the increases, arrests of illegal border crossers remain at the lowest point since 1971.

Associated Press writer Christopher Sherman contributed to this report from McAllen, Texas.

Azarenka beats Li, defends Australian Open title

MELBOURNE, Australia (AP) ? Victoria Azarenka had the bulk of the crowd against her. The fireworks were fizzling out, and when she looked over the net she saw Li Na crashing to the court and almost knocking herself out.

Considering the cascading criticism she'd encountered after her previous win, Azarenka didn't need the focus of the Australian Open final to be on another medical timeout.

So after defending her title with a 4-6, 6-4, 6-3 victory over the sixth-seeded Li in one of the most unusual finals ever at Melbourne Park, Azarenka understandably dropped her racket and cried tears of relief late Saturday night.

She heaved as she sobbed into a towel beside the court, before regaining her composure to collect the trophy.

"It isn't easy, that's for sure, but I knew what I had to do," the 23-year-old Belarusian said. "I had to stay calm. I had to stay positive. I just had to deal with the things that came onto me."

There were a lot of those things squeezed into the 2-hour, 40-minute match. Li, who was playing her second Australian Open final in three years, twisted her ankle and tumbled to the court in the second and third sets.

The second time was on the point immediately after a 10-minute delay for the Australia Day fireworks ? a familiar fixture in downtown Melbourne on Jan. 26, but not usually coinciding with a final.

Li had been sitting in her chair during the break, while Azarenka jogged and swung her racket around before leaving the court to rub some liniment into her legs to keep warm.

The 30-year-old Chinese player had tumbled to the court after twisting her left ankle and had it taped after falling in the fifth game of the second set. Immediately after the fireworks ceased, and with smoke still in the air, she twisted the ankle again, fell and hit the back of her head on the hard court.

The 2011 French Open champion was treated immediately by a tournament doctor and assessed for a concussion in another medical timeout before resuming the match.

"I think I was a little bit worried when I was falling," Li said, in her humorous, self-deprecating fashion. "Because two seconds I couldn't really see anything. It was totally black.

"So when the physio come, she was like, 'Focus on my finger.' I was laughing. I was thinking, 'This is tennis court, not like hospital.'"

Li's injury was obvious and attracted even more support for her from the 15,000-strong crowd.

Azarenka had generated some bad PR by taking a medical timeout after wasting five match points on her own serve in her semifinal win over American teenager Sloane Stephens on Thursday. She came back after the break and finished off Stephens in the next game, later telling an on-court interviewer that she "almost did the choke of the year."

She was accused of gamesmanship and manipulating the rules to get time to regain her composure against Stephens, but defended herself by saying she actually was having difficulty breathing because of a rib injury that needed to be fixed.

That explanation didn't convince everybody. So when she walked onto Rod Laver Arena on Saturday, there were some people who booed, and others who heckled her or mimicked the distinctive hooting sound she makes when she hits the ball.

"Unfortunately, you have to go through some rough patches to achieve great things," she said. "That's what makes it so special for me. I went through that, and I'm still able to kiss that beautiful trophy."

She didn't hold a grudge.

"I was expecting way worse, to be honest. What can you do? You just have to go out there and try to play tennis in the end of the day," she said. "It's a tennis match, tennis battle, final of the Australian Open. I was there to play that.

"The things what happened in the past, I did the best thing I could to explain, and it was left behind me already."

The match contained plenty of nervy moments and tension, and 16 service breaks ? nine for Li. But it also produced plenty of winners and bravery on big points.

Azarenka will retain the No. 1 ranking she's mostly held since her first Grand Slam win in Melbourne last year.

Li moved into the top five and is heartened by a recent trend of Australian runner-ups winning the French Open. She accomplished that in 2011, as did Ana Ivanovic (2008) and Maria Sharapova (2012).

"I wish I can do the same this year, as well," Li said.

Later Saturday, Bob and Mike Bryan won their record 13th Grand Slam men's doubles title, defeating the Dutch team of Robin Haase and Igor Sijsling 6-3, 6-4.

Sunday's men's final features two-time defending champion Novak Djokovic and U.S. Open winner Andy Murray. Djokovic is seeking to become the first man in the Open era to win three titles in a row in Australia.

Azarenka was planning a night of partying to celebrate her second major title, with her friend Redfoo and the Party Rock crew, and was hopeful of scoring some tickets to the men's final.

She said she needed to let her hair down after a draining two weeks and hoped that by being more open and frank in recent times she was clearing up any misconceptions the public had of her.

"When I came first on the tour I kind of was lost a little bit," he said. "I didn't know how to open up my personality. It's very difficult when you're alone. I was independent since I was, you know, 10 years old. It was a little bit scary and I wouldn't show my personality.

"So the (last) couple of years I learned how to open up to people and to share the moments. I wasn't really good before. I hope I got better. It's your judgment."

Map locates Santa Maria, Brazil

(AP) ? Flames raced through a crowded nightclub in southern Brazil early Sunday, killing more than 230 people as panicked partygoers gasped for breath in the smoke-filled air, stampeding toward a single exit partially blocked by those already dead. It appeared to be the world's deadliest nightclub fire in more than a decade.

Witnesses said a flare or firework lit by band members started the blaze in Santa Maria, a university city of about 225,000 people, though officials said the cause was still under investigation.

Television images showed smoke pouring out of the Kiss nightclub as shirtless young men who had attended a university party joined firefighters using axes and sledgehammers to pound at windows and walls to free those trapped inside.

Guido Pedroso Melo, commander of the city's fire department, told the O Globo newspaper that firefighters had a hard time getting inside the club because "there was a barrier of bodies blocking the entrance."

Teenagers sprinted from the scene desperately seeking help. Others carried injured and burned friends away in their arms.

"There was so much smoke and fire, it was complete panic, and it took a long time for people to get out, there were so many dead," survivor Luana Santos Silva told the Globo TV network.

The fire spread so fast inside the packed club that firefighters and ambulances could do little to stop it, Silva said.

Another survivor, Michele Pereira, told the Folha de S. Paulo newspaper that she was near the stage when members of the band lit flares that started the conflagration.

"The band that was onstage began to use flares and, suddenly, they stopped the show and pointed them upward," she said. "At that point, the ceiling caught fire. It was really weak, but in a matter of seconds it spread."

Guitarist Rodrigo Martins told Radio Gaucha that the band, Gurizada Fandangueira, started playing at 2:15 a.m. "and we had played around five songs when I looked up and noticed the roof was burning"

"It might have happened because of the Sputnik, the machine we use to create a luminous effect with sparks. It's harmless, we never had any trouble with it.

"When the fire started, a guard passed us a fire extinguisher, the singer tried to use it but it wasn't working"

He confirmed that accordion player Danilo Jacques, 28, died, while the five other members made it out safely.

Police Maj. Cleberson Braida Bastianello said by telephone that the toll had risen to 233 with the death of a hospitalized victim ? he said earlier that the death toll was likely made worse because the nightclub appeared to have just one exit through which patrons could exit.

Officials counted 232 bodies that had been brought for identification to a gymnasium in Santa Maria, which is located at the southern tip of Brazil, near the borders with Argentina and Uruguay.

Federal Health Minister Alexandre Padhilha told a news conference that most of the 117 people treated in hospitals had been poisoned by gases they breathed during the fire. Only a few suffered serious burns, he said.

Brazil President Dilma Roussef arrived to visit the injured after cutting short her trip to a Latin American-European summit in Chile.

"It is a tragedy for all of us," Roussef said.

Most of the dead apparently were asphyxiated, according to Dr. Paulo Afonso Beltrame, a professor at the medical school of the Federal University of Santa Maria who went to the city's Caridade Hospital to help victims.

Beltrame said he was told the club had been filled far beyond its capacity during a party for students at the university's agronomy department.

Survivors, police and firefighters gave the same account of a band member setting the ceiling's soundproofing ablaze, he said.

"Large amounts of toxic smoke quickly filled the room, and I would say that at least 90 percent of the victims died of asphyxiation," Beltrame told The Associated Press by telephone.

"The toxic smoke made people lose their sense of direction so they were unable to find their way to the exit. At least 50 bodies were found inside a bathroom. Apparently they confused the bathroom door with the exit door."

In the hospital, the doctor "saw desperate friends and relatives walking and running down the corridors looking for information," he said, calling it "one of the saddest scenes I have ever witnessed."

Rodrigo Moura, identified by the newspaper Diario de Santa Maria as a security guard at the club, said it was at its maximum capacity of between 1,000 and 2,000, and partygoers were pushing and shoving to escape.

Santa Maria Mayor Cezar Schirmer declared a 30-day mourning period, and Tarso Genro, the governor of the southern state of Rio Grande do Sul, said officials were investigating the cause of the disaster.

The blaze was the deadliest in Brazil since at least 1961, when a fire that swept through a circus killed 503 people in Niteroi, Rio de Janeiro.

Sunday's fire also appeared to be the worst at a nightclub since December 2000, when a welding accident reportedly set off a fire at a club in Luoyang, China, killing 309.

In 2004, at least 194 people died in a fire at an overcrowded nightclub in Buenos Aires, Argentina. Seven members of a band were sentenced to prison for starting the flames.

Several years later, in December 2009, a blaze at the Lame Horse nightclub in Perm, Russia, killed 152 people after an indoor fireworks display ignited a plastic ceiling decorated with branches.

Similar circumstances led to a 2003 nightclub fire that killed 100 people in the United States. Pyrotechnics used as a stage prop by the 1980s rock band Great White set ablaze cheap soundproofing foam on the walls and ceiling of a Rhode Island music venue.

The band performing in Santa Maria, Gurizada Fandangueira, plays a driving mixture of local Brazilian country music styles. Guitarist Martin told Radio Gaucha the musicians are already seeing hostile messages.

"People on the social networks are saying we have to pay for what happened," he said. "I'm afraid there could be retaliation".

"Our Weapon Is The Truth": K12 Inc. Sued Over For-Profit Education ...

Dozens of former employees claim that?K12 Inc,?a for-profit education company, used dubious and sometimes fraudulent tactics to mask astronomical rates of student turnover in its national network of cyber charter schools.

K12 manages Agora, the second largest cyber charter in Pennsylvania. The company is also involved in pending applications to open two new cybers in the state. The Pennsylvania Department of Education is expected to decide on the proposals later this month.

The former employees allege that K12-managed schools aggressively recruited children who were ill-suited for the company?s model of online education. They say the schools then manipulated enrollment, attendance and performance data to maximize tax-subsidized per-pupil funding.

These claims by anonymous ?confidential witnesses? are spelled out in court documents filed last June as part of a class-action lawsuit by the company?s investors.

ALLEGATIONS TOUCH UPON AGORA

Many of the allegations come from people who worked for the Agora Cyber Charter School, based in Wayne, Pa. With more than 8,000 students, Agora enrolls roughly a quarter of the 32,000 Pennsylvania students that have opted to attend cybers, which are independently managed schools providing mostly online instruction.

The class action suit against K12, Inc. and its executives was filed last January, shortly after a critical article about the company appeared in the New York Times. The investors allege that the company committed securities fraud when senior officials, including CEO Ronald J. Packard, ?concealed from the market? information about high rates of student withdrawal and poor academic performance.

?The core omission behind the Defendants? fraudulent success story was that K12 students were dropping out at staggering rates,? reads the complaint.?MORE

Death toll from Port Said rising

Another ugly chapter in the Port Said tragedy is playing out in Egypt today with 22 killed and more than 200 injured after courts sentenced 21 to death in connection with last February?s stadium disaster.

Looking back on the week leading up to the verdict, it appeared some spark of violence was inevitable. Supporters of Cario-based club Al Ahly, who saw many of their supporters killed in the Feb. 1, 2011 tragedy, looked to judge?Sobhy Abdel Maguid?s verdict as an opportunity for justice, threatening their own reaction should judgment not be harsh enough. Fans of Port Said club Al-Masry, however, had been wary of a possibly politically motivated court placing disproportionate blame on their fans.

Violence started soon after the court?s verdict was read, with Egyptian state television reporting gunshots were heard near a Port Said prison were suspects were being detained. Tear gas was also fired in the area of supporters gathered near the facility in support of the accused.

Last February, 79 people were killed after violence at the end of an Al-Masry-Al Ahly match. A panic that started after Al-Masry fans attacked rival supporters led to over 1,000 injuries, the?casualties?caused by the post-match crush as well as weaponry Al-Masry fans had brought to the match.

Amid security concerns, the rest of the Egyptian Premier League season was subsequently cancelled. The league is scheduled to re-start play on February 2.

Today?s violence reflects Egypt?s still tenuous political state, with Al-Masry supporters having always suspected last year?s tragedy presented an opportunity for the country?s post-Honsi Mubarak government to crack down on a known liberal group. Yet had the verdicts failed to come down hard on those involved in the tragedy, the violence could have been in Cairo. Al Ahly fans would have acted against the perceived lenient sentences on a group of suspects they see as responsible for last year?s deaths. Either way, we would have seen a display of one group?s lack of faith in Egypt?s justice system.

For soccer fans, it?s another example of the game serving as a crude tool for others? politics, whether that use was intended last February or not. Regardless, after today?s verdict and violent response, the death toll from last year?s disaster is set to rise to 112, should the court?s sentences be carried out.

Whole Foods CEO John Mackey is stirring people up again, alienating enough of his own customers that he?s been forced to do some backpedaling. Last week in an interview with Mother Jones, Mackey said:

In general, most of humanity tends to flourish more when global temperatures are in a warming trend and I believe we will be able to successfully adapt to gradually rising temperatures. What I am opposed to is trying to stop virtually all economic progress because of the fear of climate change. I would hate to see billions of people condemned to remain in poverty because of climate-change fears.

This is the same guy who just today?told the LA Times,

Business, ?has ?a horrible reputation.?

But instead of being ?selfish and greedy and exploitative,? as it?s often portrayed, business is actually ?the greatest force for good on this planet,? he said at a Westside gathering Thursday night.

?I?m an unabashed, complete free-enterprise capitalist enthusiast,? he said. ?I see business as fundamentally heroic ? [but] it could be so much better.?

This is the same guy who, in a discussion about?President Obama?s health care overhaul with?NPR?s?Steve Inskeep, said that the new health care legislation is ?fascism.?

?Technically speaking, it?s more like fascism. Socialism is where the government owns the means of production. In fascism, the government doesn?t own the means of production, but they do control it ? and that?s what?s happening with our health care programs and these reforms.?

The comment made so many?Whole Foods shoppers angry, Mackey was forced to step back his comments.

This is the same guy who, in 2007, the Denver Post said was a ?half-wit,? when he was accused of stock manipulation after he was caught using a?pseudonym:

Chief executive John Mackey?s admission of pseudonymous postings on a Yahoo message board reeks of possible stock manipulation and securities violations, not to mention juvenile judgment, gross arrogance, poor ethics and bad hair.

?If it was any other employee of the company, he would be fired,? said Lynn Turner, former chief accountant of the Securities and Exchange Commission. ?The board should fire him.?

In more than 1,000 postings from 1999 through last August, Mackey took on Whole Foods critics, blasted the competition and talked up the organic grocer?s prospects as if he were just another bullish investor in the company.

He ?voluntarily stepped down from his position as chairman of the board? after that kerfuffle.

Maybe I?m just missing something, but it seems to me that the typical Whole Foods customer demographic is exactly the type of person who is most likely to be offended by these comments. It?s time for him to go.

Bankruptcy expert says 2013 doesn't look good for these industries

By Nick Brown

NEW YORK (Reuters) - Mid-market defense contractors as well as media and coal companies could be at risk of tumbling into bankruptcy in 2013, credit market guru and New York University professor Edward Altman said on Thursday.

With the U.S. government mulling significant cuts to the defense budget, smaller companies that contract with the government for defense projects could suffer, Altman told a group of restructuring professionals at his 12th annual Corporate & Sovereign Credit Market Outlook luncheon.

Altman is known for establishing the so-called "Z-score" method of predicting a company's bankruptcy risk.

He did not name defense companies he thinks could be bankruptcy candidates, but he said the problems likely would hit smaller firms and that larger ones are not in danger.

In an interview with Reuters after his speech, Altman said the coal industry is expected to continue to suffer as natural gas remains a cheaper energy alternative. One major player in that industry - Patriot Coal Corp (PCXCQ.PK) - filed for bankruptcy last year, blaming in part the glut of natural gas.

Altman said media companies will also face challenges as specialized online media outlets gain strength.

"The Internet media world is getting very crowded," Altman said in the interview.

Corporate bankruptcies have been less common in recent years as lenders and governments have been more willing to lend to struggling companies.

In his presentation, Altman said he expects that to change over the next several years, but not necessarily in 2013.

Also at the event, sponsored by bankruptcy trade group the Turnaround Management Association, restructuring experts offered varying outlooks on the business side of the field.

Flip Huffard, a managing director at The Blackstone Group (BX), said many companies that refinanced or extended debt maturities several years ago may not be in a position to do so again.

"These are companies that are getting to the end of the line, and actually need to fix their capital structures," Huffard said. "They're done with Band-Aids."

Indictment: Credit Counseling Firm Laundered Cash From ...

marijuanaTwo people have been charged with laundering cash from marijuana trafficking through a non-profit credit counseling agency in Kansas City, U.S. Attorney Barry Grissom said today.

Mendy Read-Forbes, 37, Platte City, Mo., and Laura Shoop, 46, Platte City, Mo., are charged in a superseding indictment with one count of conspiracy to commit money laundering, one count of conspiracy to possess with intent to distribute marijuana and one count of possession with intent to distribute marijuana. In addition, Read-Forbes is charged with 16 counts of money laundering and Shoop is charged with eight counts of money laundering.

The indictment alleges that Forbes and Newhard Credit Solutions was registered as a nonprofit organization that provided credit counseling services to people who were in bankruptcy proceedings. Forbes held herself out as the owner and operator of the agency. Shoop was an acquaintance of Forbes who worked at various times for the agency.

In March and April 2012, Forbes was introduced to an undercover officer posing as a marijuana dealer. Forbes offered to devise a scheme to launder the dealer?s drug proceeds. As part of the scheme, Forbes offered to deposit money given to her by the drug dealer into the bank accounts of Forbes and Newhard Credit Solutions or related companies and then to return the money to the dealer via checks, money orders or wire transfers. The bank accounts were in Kansas.

To make the transactions appear legitimate, Forbes gave the drug dealer a contract titled ?Purchase and Sale of Business Agreement.? The contract, bearing the signature of the drug dealer and another person known to the grand jury, made it appear that the marijuana dealer was purchasing assets of FCP, Inc., a corporation controlled by Forbes and another person.

To make it appear that the drug dealer was engaged in business as a certified credit counselor with Forbes and Newhard Credit Solutions, Forbes gave the drug dealer a certificate saying he had completed training as a bankruptcy specialist.

In addition, Forbes created a company called Maximum Lawn Care, LLC, and opened bank accounts where cash from the drug dealer was deposited.

Forbes agreed not to charge a fee for laundering the drug dealer?s money until she had laundered $170,000 so that the dealer could use the funds to purchase more marijuana. Forbes also agreed to let the drug dealer store 40 pounds of marijuana at her house.

If convicted, they face a maximum penalty of 20 years and a fine up to $250,000 on the charge of conspiracy to commit money laundering and each of the money laundering counts; and a maximum penalty of five years and a fine up to $250,000 on each of the two marijuana counts.

The Kansas Bureau of Investigation, the U.S. Secret Service, the Internal Revenue Service and the Department of Housing and Urban Development investigated. Assistant U.S. Attorney Chris Oakley and Assistant U.S. Attorney Jabari Wamble are prosecuting.

OTHER INDICTMENTS

The complaint alleged that on Jan. 9 the Wichita Police Department was called to a report of shots fired at the McDonald?s restaurant at 6350 W. Kellogg in Wichita. The victims reported that the disturbance had begun when another car tried to cut in front of them in the drive thru. They said a male in the other car had stepped out of the vehicle and fired a shotgun at them. The blast struck the post between the driver?s side front and back doors of the victims? car.

While investigating the case, Wichita police officers served a search warrant at 2440 Newell in Wichita. Costa was arrested and police recovered a Mossberg pump action shotgun from a crawl space next to Costa?s bed. Costa denied shooting the gun at McDonald?s.

Because had a prior felony conviction on a charge of aggravated assault in 2011 he was prohibited from possessing a firearm under federal law.

If convicted, he faces a maximum penalty 10 years in federal prison and a fine up to $250,000. Assistant U.S. Attorney Matt Treaster is prosecuting.

The six biggest moments from the season premiere of ?The Ultimate Fighter?

The latest version of "The Ultimate Fighter" debuted on Tuesday night. For the first time in many, many seasons, I enjoyed the show. Instead of focusing on the animosity between coaches, it brought out the stories of each of the fighters. It was a welcome change. Here were the biggest moments of the two-hour premiere:

-- The opening montage: From the start, TUF looked different than it had before. The filming style felt more like an "NFL Films" production than previous TUFs. That started with the opening montage, with close-ups of the coaches, Dana White and the fighters talking about why they want to be on the show.

-- Families fighters and friends being allowed in the gym: Seeing Adam Cella's family celebrate after his win set the tone for the rest of the show. On previous TUFs, fighters would talk about their devotion to their amily and friends, but it was hard to connect with them when all we saw were pictures. Now, as the season goes on, we'll know who each man is fighting for much more richly.

-- Zak Cummings' knockout of Nik Fekete: It was so quick that I wasn't sure what happened. The replay showed Fekete didn't protect himself when throwing a kick, and that ended his show at making "The Ultimate Fighter."

-- Sonnen needling Jones over Bubba McDaniel: The "Chael Shtick" didn't come out much on Tuesday night, and that's a good thing. Over the course of the show, it would get old very quickly. But Sonnen's subtle, sarcastic picking at Jones was fun, particularly when it came to Jones' teammate and if Jones would pick him for his team.

-- "I grew up on food stamps, powdered milk and spam." With the families around, there were more tears than usual for the opening show. No episode was more moving than Kito Andrews saying goodbye to his kids, and talking about why it's so important for him to win. Unfortunately, Andrews lost the decision.

-- Uriah Hall's decision over Andy Endz: The two put on such a great fight that Sonnen stood and cheered for it. Afterwards, they shared a quiet moment where Hall thanked Endz, and Endz told Hall to win the show. It was one of the moments that reminded fans that most fighters support each other, even when they haven't met before.

What did you think of the show? Speak up in the comments, on Facebook or on Twitter.

Fontana, Calif., schools get high-powered rifles

FONTANA, Calif. (AP) ? The high-powered semiautomatic rifles recently shipped to school police in this Southern California city look like they belong on a battlefield rather than in a high school, but officials here say the weapons could help stop a massacre like the one that claimed the lives of 26 students and educators in Connecticut just weeks ago.

Fontana Unified School District police purchased 14 of the Colt LE6940 rifles last fall, and they were delivered the first week of December ? a week before the shooting at Sandy Hook Elementary School. Over the holiday break, the district's 14 school police officers received 40 hours of training on the rifles. Officers check them out for each shift from a fireproof safe in the police force's main office.

Fontana isn't the first district to try this. Other Southern California districts also have rifle programs ? some that have been in operation for several years. Fontana school police Chief Billy Green said he used money from fingerprinting fees to purchase the guns for $14,000 after identifying a "critical vulnerability" in his force's ability to protect students. The officers, who already wear sidearms, wouldn't be able to stop a shooter like the one in Connecticut, he said Wednesday.

"They're not walking around telling kids, 'Hurry up and get to class' with a gun around their neck," the chief said. "Parents need to know that if there was a shooter on their child's campus that was equipped with body armor or a rifle, we would be limited in our ability to stop that threat to their children."

Some parents and students, however, reacted with alarm to the news that school resource officers were being issued the rifles during their shifts. The officers split their time between 44 schools in the district and keep the rifles in a safe at their assigned school or secured in their patrol car each day before checking the weapon back in to the school police headquarters each night.

"If the wrong person gets ahold of the gun, then we have another shooter going around with a gun. What happens then, if that situation occurs?" said James Henriquez, a 16-year-old sophomore who just enrolled at Fontana High School this week after moving from Texas.

Other students said they felt disillusioned that officials would spend money on semiautomatic rifles while the district eliminated its comprehensive guidance counseling program two years ago.

"They should get guns, but not as many and not spend so much money on them," said student Elizabeth Tovar. "They should use the money to get back our counselors because a lot of us really need them."

The district saved millions by restructuring guidance services, said Superintendent Cali Olsen-Binks.

"I understand that people are looking at the layoffs, but $14,000 and $7 million is a huge disparity," she said.

The 40,000-student district came up with the school rifle program after consulting with top school safety experts and looking at what other large districts had done, said Olsen-Binks.

Santa Ana Unified School District, in nearby Orange County, has had a rifle program for about two years that operates similarly to the one Fontana has started, said police Cpl. Anthony Bertagna.

The Los Angeles School Police Department also deploys rifles to its officers as needed, the department said in a statement. It would not say how many rifles district police have but said the weapons are kept in the department's armory and are handed out and returned daily.

The San Bernardino City Unified School District police force purchased four Bushmaster semiautomatic rifles last July, said Linda Bardere, a district spokeswoman.

Fontana is a city of about 200,000 people east of Los Angeles.

"I came from a teaching background, and it's appalling to think that we'd have to have security officers ? let alone armed police officers ? on our campuses. But the bottom line is ... everybody has anxiety over school safety right now," Olsen-Binks said. "Our police officers said they would take a bullet for these kids and because they are willing to put their lives on the line, they need to be equipped for all scenarios."

Only sergeants are authorized to check out the rifles from the police armory, where they are kept. All officers have been trained for years to use the rifles.

The Fontana rifle purchase did not require approval from the school board but member Leticia Garcia said she believes there should have been a public discussion before they were purchased.

"We're talking about a war-zone rifle, and so are we going to militarize our public schools?" Garcia asked. "We have to provide a safe haven for people to learn ... but this, to me, seems a little bit too much."

(AP) ? For at least a week, authorities say, 15-year-old Nehemiah Griego had been planning the attack.

After shooting his mother and three siblings in their beds, he ambushed his father as the pastor returned home from an overnight shift at a homeless shelter. Then the teen reloaded the family's rifles.

His plan was to randomly shoot people at a Wal-Mart on Saturday, which happened to be "Guns Across America" day, until he could be killed in a shootout with law enforcement, according to authorities.

He also contemplated killing his 12-year-old girlfriend's parents, Bernalillo County Sheriff Dan Houston said Tuesday.

And while Griego loaded guns and ammunition into the family's van, Houston said, it was unclear whether the teen did go to a Wal-Mart or how seriously he contemplated continuing his rampage on the same day that thousands of gun advocates gathered peacefully at state capitals around the country to rally against stricter limits on firearms.

The "Guns Across America" events were held after President Barack Obama unveiled a sweeping package of federal gun-control proposals.

What authorities know, the sheriff said, was that Griego texted a picture of his dead mother to his girlfriend, then spent much of Saturday with her and her family, authorities said. That evening, he went to the church where his father worked and confessed to killing his parents and three younger siblings, authorities said.

The sheriff said he didn't know if Griego's contact with his girlfriend avoided further bloodshed. But he said she apparently knew what had happened, and officials were investigating whether she should be charged with failing to report the crime.

"We know Nehemiah had been contemplating this for some time," Houston told reporters at a news conference. Griego apparently had told others of his plans, but whom and when were still under investigation, Houston said.

The motive, Houston said, "was purely that he was frustrated with his mother. He did not give any further explanation."

The teen waived his right to arraignment in adult criminal court Tuesday on charges of murder and child abuse resulting in death and was ordered held without bond. He was arrested Saturday at his family's home in a rural area southwest of Albuquerque.

The sheriff's office identified the dead as Greg Griego, 51, his wife, Sarah Griego, 40, and three of their children: a 9-year-old boy, Zephania Griego, and daughters Jael Griego, 5, and Angelina Griego, 2.

According to Houston and charging documents, it began early Saturday at the family's home, when Nehemiah Griego acted on what he described to investigators as homicidal and suicidal thoughts.

Houston said the teen shot her as she slept at about 1 a.m. with a .22-caliber rifle the parents kept in a closet. He said he killed his siblings and then grabbed his parents' .223-caliber rifle and waited downstairs to ambush his father as he returned from work around 5 a.m.

Griego told authorities he then reloaded the two guns and put them in the family van. Houston said officers found the rifles, as well as at least a dozen rounds for the .22 and a handful of rounds for the other rifle, in the van.

At about 8 p.m., Griego went to Calvary church and told church members that his family was dead. Church officials called 911 and took Griego to his home.

Griego told detectives he discovered his family dead after returning from a friend's house, court documents say. The teen later confessed to shooting his mother because he "had anger issues" and was annoyed with her, the documents say.

The teen had no history of mental illness, and drugs or alcohol did not appear to be a factor, Houston said. He noted that the teen liked violent video games such as "Modern Warfare" and "Grand Theft Auto." He did not say whether he believed the games were a factor.

The boy's uncle, Eric Griego, said in an emailed statement on behalf of the family that the teen is "bright, curious and incredibly talented" with a love of music and sports.

"It is clear to those of us who know and love him that something went terribly wrong. Whether it was a mental breakdown or some deeper undiagnosed psychological issue, we can't be sure yet," the statement said.

Greg Griego was a gang member-turned pastor who had served at Calvary, one of Albuquerque's largest Christian churches. He had an extensive arrest record from his gang days, but was best known throughout the law enforcement community for his work as a voluntary chaplain.

Calvary Pastor Skip Heitzig said in a statement Tuesday that the deaths have stunned the church community. "We are doing what we can as a church body to minister to the remaining family members," he said. "Only the Lord Jesus Christ can heal this type of pain and heartache."

A records check by the Children, Youth and Families Department indicated no problems with the family and that Nehemiah Griego had never been in trouble with the law.

Sheriff's Deputy Aaron Williamson confirmed there was no history of any emergency calls to the home in the recent past.

"This is beyond any human reasoning or understanding," Houston said.

"It's horrific. What other words do you use? This is certainly the first time that I have been into a crime scene with this much destruction at one home."

In addition to the two rifles, two pistol-grip shotguns were in the home, Houston said. Griego's father taught him to use guns, and they shot together on a regular basis, Houston said.

Eric Griego's statement said the family had "differing views on gun rights and gun control" and asked the media "to not use Nehemiah as a pawn for ratings or to score political points.

"He is a troubled young man who made a terrible decision that will haunt him and his family forever."
