Did This Medical Witness Defraud Thousands of Worker's ...

A medical expert regularly employed by insurance companies to undercut workers' compensation claims lied about how extensive his exams were. The story starts back in April at a Queens Supreme Court hearing assessing whether laborer Manuel Bermejo workers' comp claim from a fall was denied due to malpractice at the hands of a New York City medical resident. The case names Amsterdam & 76th Associates, LLC, Ibex Construction, LLC and Marble Techniques, Inc., as defendants.

The defense hired Dr. Katz to refute the claim. In his expert testimony Katz claimed that his examination lasted for 20 minutes. Little did the insurance company know, the plaintiff's lawyer had a secret recording of the exam, showing that it lasted exactly one minute and 56 seconds.

According a court transcript obtained by New York Personal Injury Law Blog (you gotta love the Internet), Bermejo's lawyer secretly recorded the exam--Bermejo's second--because he believed Katz lied about the length of the first exam, which Katz said lasted a whopping 45 minutes. The admission of the recording forced presiding Judge Duane Hart to declare a mistrial.

When the Voice contacted Katz regarding his role in the case, he vehemently denied being a "shill" for insurance companies, and insisted he was siding with the city hospital "for the children."

"Every erroneous payment made by The City of New York costs thousands of deserving children a decent education," he says.

Katz also explains that "my review was based on an extensive review of records and the issue was not the clinical exam which was abnormal but causality. Causality references the literature, the mechanism of injury and extensive clinical experience," meaning that the relevant parts of the exam would not have necessarily been physical.

Katz has a history of extremely short exam times and at least one prior challenge to his examinations in court. He also did not appear for a hearing Judge Hart called on Monday to assess the extent of Katz's possible perjury.

Katz is a professional expert witness. He has performed thousands of these procedures, meaning there could be thousands of workers who were defrauded out of their worker's comp. Katz, for his part, feels he is being persecuted.

"This was an assassination attempt against me to obtain outsize settlements with little expenditure of effort," he says.

"We made a decision to remove Aaron Hernandez from Madden NFL 25 and NCAA Football 14. Because NCAA Football 14 was finalized prior to our decision, Hernandez' image still appears in the Nike Skills Trainer. However, he is not in the game, and anyone who unlocks that particular Nike Skills Trainer reward will receive an Alex Smith Ultimate Team player item instead."

Hernandez's image will be removed via a Title Update at a later time. The athlete was arrested at his home on June 26 in connection with a recent homicide, and he currently sits in jail awaiting charges of first-degree murder. He is accused of killing semi-pro football player Odin Lloyd and other unsettling information about Hernandez's past is coming to light. "Innocent until proven guilty" and all that, but it's not lookin' good.

Tanzania wants energy firms to speed up gas production

DAR ES SALAAM (Reuters) - Tanzania wants energy firms to speed up production of natural gas that it hopes will help end poverty in east Africa's second-biggest economy.

Discoveries in Tanzania's and Mozambique's waters have led to predictions the region could become the world's third-largest exporter of natural gas. Tanzania alone estimates it has 41.7 trillion cubic feet (tcf) of recoverable natural gas reserves.

"Preparations for drilling should not take a long time, such as 10 years ... that is too long, because the people want to see benefits of the natural gas as soon as possible," President Jakaya Kikwete said in a statement issued by his office on Monday.

"We want this gas to benefit our people - to lift them out of poverty. If we earn $1 billion in annual revenues from the gas, then we can transform our country into (a) paradise."

Although the gas finds are large, facilities need to be built to enable the development of the gas.

Britain's BG Group, its exploration partner and Norway's Statoil, which have all discovered gas, say they plan to build a $10 billion liquefied natural gas (LNG) terminal. The terminal would be well placed for exports to Asia.

Tanzania's cabinet plans to approve a national gas policy as well as a set of new laws soon to regulate the gas industry, which could quicken the pace of development by defining how the country's citizens would share in the gas boom.

In the southern region of Mtwara, residents have held deadly protests against the construction of a 532 km (330 mile) pipeline, financed by a Chinese loan, calling for a bigger share of benefits from gas development.

The pipeline runs from the south of the country to the commercial capital and main port in the country, Dar es Salaam.

Patrick Berry (The King) most recently appeared on stage as Helen Keller?s father in RLT?s The Miracle Worker. Chinese state media revealed that two 16-year-old Chinese citizens, Ye Mengyuan and Wang Linjia, were killed. The other 305 people on board survived.

GOP Governor Struggles To Meet Recusal Pledge

NASHVILLE, Tenn. -- Tennessee Gov. Bill Haslam has struggled almost from the start of his administration to fulfill a campaign pledge to avoid handling matters relating to Pilot Flying J, the family-owned truck stop chain run by his brother, Cleveland Browns owner Jimmy Haslam.

Now, an FBI investigation of alleged fraud by the sales staff at the nation's largest diesel retailer has brought increased scrutiny of the company and raised more questions about links between the governor and Pilot. They include:

_ A top political adviser to the governor who also is orchestrating Pilot's public response to the Justice Department investigation.

_ A current board member and part-owner of Pilot being appointed by the governor as the interim president of University of Memphis.

_ Another board member running the parent company of a mining firm that wants to extract coal from public land in Tennessee.

Haslam's connections to Pilot were a central theme in the 2010 Republican primary and general election. Opponents attacked Haslam for refusing to disclose his personal ownership stake in the company, hammered the company for price gouging settlements after gas shortages caused by a hurricane, and derided the candidate as a billionaire oil man who would do the bidding of his father, Pilot founder Jim Haslam, and brother, Jimmy, the company's CEO, if elected.

The Haslam campaign rebutted those attacks largely by citing Pilot's "history of operating with integrity" and by criticizing "smears about a home-grown successful company." Those blanket dismissals will be harder to make in the future as the company grapples with fallout from the raid by federal agents and subsequent guilty pleas of five Pilot employees.

Haslam's chief campaign strategist was Tom Ingram, who has remained a paid adviser since the election while orchestrating Pilot's public response to the FBI raid.

Ingram, who also lobbies state government on behalf of other private clients such as the mining company seeking to extract coal from public lands, has said he doesn't lobby the governor directly. He shrugged off a reporter's question about whether he will stop his outside activities on behalf of Pilot once he's brought on to Haslam's re-election campaign payroll this summer.

"Of course not," he said. "Why would I?"

The governor also declared himself unconcerned about Ingram's other roles, including his position with Pilot.

"That's just how life works a lot of time," Haslam said recently. "Look, there's a whole lot of lobbyists who represent a whole lot of different people."

Dick Williams, who chairs Common Cause Tennessee, said the governor's deep connections to the business world ? and his refusal to make full disclosures ? raise questions about his impartiality.

"He just has so many relationships, business agreements and investments that it causes a serious potential for a conflict of interest," Williams said. "It's just hard to untangle that."

As he persevered in a tough GOP primary and trounced his Democratic opponent in the 2010 general election, Haslam promised that he wouldn't participate directly in government matters relating to Pilot. That pledge faced an early test in the governor's first year in office over a decision to request a federal waiver on gasoline standards after explosion at the Valero refinery in Memphis, which was Pilot's largest fuel supplier in the area.

Haslam acknowledged that he had spoken to his brother about earlier problems at the refinery but said he had delegated that decision to his deputy, Claude Ramsey.

"Obviously as governor I can't just totally abdicate my responsibilities," he said at the time. "But because I knew that somebody like you someday would ask a question, I said find out the right answer, talk to the local folks as well as our (Department of Environment and Conservation) people and come up with the right answer."

The state ultimately requested and was later granted permission by the U.S. Environmental Protection Agency to relax fuel standards.

A month later, Haslam endorsed his brother's right to speak out in a letter to the governor and other state officials against privatizing state-run rest stops along interstate highways.

"He's the CEO of a major Tennessee business that has their interests to defend," Haslam said. "And that's nothing new: Pilot's been talking about that, as has everybody else that has an interstate business ? from McDonald's to everybody ? else for years."

Jimmy Haslam has been doing furious damage control since the April 15 raid on company headquarters and the subsequent release of an FBI affidavit with transcripts of secretly recorded conversations among the sales staff. Federal agents say the conversations outline a scheme to defraud trucking companies of fuel rebates. Five members of the sales staff have pleaded guilty to mail fraud and are cooperating with prosecutors, as are two further current and former Pilot staffers.

The governor has maintained that he has had no active role in Pilot since leaving the company to run for Knoxville mayor in 2003. But his family continues to own a majority share in the privately-held company with annual revenues of $31 billion, and Haslam has kept his personal share outside of a blind trust established for his other investments.

Haslam earlier this year named businessman Brad Martin ? who once hired him as an executive at Saks Inc. in New York ? as interim president of the University of Memphis. While Pilot has refused to publicly disclose the makeup of its board, it identified Martin as a director when it announced he would supervise the internal investigation into the FBI allegations. Incorporation papers field in Kentucky also indicate that Martin is a co-owner in the company.

The Kentucky filings also show that Mike Loya, president and CEO of the Vitol Group's North and South American operations, is another board member. Vitol owns the company seeking coal mining permits in the Catoosa Wildlife Management Area near Crossville. Haslam adviser Ingram is also a lobbyist for the coal company.

Haslam has said he doesn't know Loya personally, and that he has had no part in the negotiations.

State Democratic Party spokesman Brandon Puttbrese said the multiple Pilot connections should cause Haslam to reconsider his refusal to disclose his income.

"The governor should quit hiding his income and come clean with taxpayers about how much money he's personally making from his endless inside dealing and show how much money he's been paid by his company Pilot Oil, which padded its corporate profits by stealing from small business owners," he said.

Egypt hits first snag over PM, Islamists call more protests

CAIRO (Reuters) - The appointment of liberal Egyptian politician Mohamed ElBaradei as interim prime minister hit a snag on Saturday, as the army-backed transitional authorities were under pressure to restore order after deadly Islamist protests.

State media and officials had said earlier that the 71-year-old Nobel Peace prizewinner and former U.N. nuclear agency chief would be named interim prime minister on Saturday evening.

But a presidential spokesman, speaking shortly before midnight, said there were several options for the job and the presidency had to take account of opposition to ElBaradei.

He mentioned no other candidates and added that there was no set date for the appointment of interim prime minister.

The Nour Party, Egypt's second biggest Islamist force, said it opposed ElBaradei and threatened to withdraw its support for the military-backed overthrow of President Mohamed Mursi on Wednesday, which was the trigger for the bloody unrest.

A youth activist who met interim head of state Adli Mansour said the two issues were linked.

Losing Nour's backing would significantly weaken the position of the military, removing any Islamist support from the transition process, fiercely opposed by Mursi's Muslim Brotherhood.

Generals said they had intervened in response to huge popular demonstrations calling for Mursi to resign.

Raising the risk of further clashes, Mursi's Muslim Brotherhood, the dominant Islamist force in the Arab world's most populous nation, called for more protests on Sunday.

At least 35 people died in violence on Friday and Saturday, as pro- and anti-Mursi demonstrators fought running street battles in Cairo, Alexandria and beyond in violence that Egypt's powerful army was barely able to contain.

Tens of thousands of Brotherhood supporters took to the streets to protest against what they called a military coup, and clashes between them, security forces and anti-Mursi protesters left more than 30 people dead.

Within minutes of the news that ElBaradei would be named, a senior Brotherhood official said that the Islamist movement would reject his candidacy and any other measures implemented by the army-backed administration.

He described ElBaradei as "Washington's choice", a reference to suspicions among Brotherhood members of U.S. complicity in Mursi's overthrow.

The Nour Party, which had endorsed the military's roadmap for a transitional phase leading to fresh elections, followed.

MAJOR CHALLENGES

While the ouster of Egypt's first freely elected president was greeted with jubilation on streets crammed with millions of people, his many supporters feared a return to the suppression that the Islamists endured for decades under autocratic rulers.

The army has given few details and no timeframe for elections, adding to political uncertainty at a time when many Egyptians fear that bloodshed could polarize society still further.

Mursi's dramatic removal and subsequent violence is the latest twist in a tumultuous two years since the fall of Hosni Mubarak in the Arab uprisings that swept the region.

At least 35 people died and more than 1,000 were wounded in the latest violence, with the army struggling to maintain order in Cairo, Alexandria and other cities and towns, where rival demonstrators fought street battles.

The most deadly clashes were in the Mediterranean city of Alexandria, where 14 people died and 200 were wounded.

In central Cairo, protesters clashed late into Friday night with stones, knives, petrol bombs and clubs as armored personnel carriers rumbled among them.

It took hours to restore order on the Nile River bridges around the landmark Egyptian Museum. Anti-Mursi activists remained encamped in a suburb of the capital, but Cairo and others cities were relatively calm as darkness fell on Saturday.

While the Brotherhood has insisted it will not resort to violence, some radical Islamists have no such inhibitions.

On Saturday, a Coptic Christian priest was shot dead in Egypt's lawless North Sinai province in what could be the first sectarian attack since Mursi's overthrow, raising concerns about the potential for further religious violence.

There were more attacks on army checkpoints in Sinai overnight and gunmen fired on a central security building in El Arish, security sources said.

A new Islamist group announced its formation in the Sinai peninsula adjoining Israel and the Gaza Strip, calling the army's removal of Mursi a declaration of war on their faith and threatening violence to impose Islamic law.

The events of the last week have raised alarm among Egypt's allies in the West, including main aid donors the United States and the European Union, and in Israel, with which Egypt has had a U.S.-backed peace treaty since 1979.

President Barack Obama condemned the violence in Egypt on Saturday and said the United States was not working with any particular Egyptian political party or group.

Newspapers quoted ElBaradei as saying that he expected Gulf Arab monarchies that were hostile to the Muslim Brotherhood's rule to offer financial support to the new authorities.

Only gas-rich Qatar provided substantial funds to Mursi's government, totaling $7 billion in loans and grants. Turkey and Libya also provided smaller loans and deposits.

RISING TENSIONS

In one of the first outbreaks of violence on Friday, three protesters were shot dead outside the Republican Guard compound where Mursi is being held, security sources said. The army denied responsibility for the shootings. It was not clear whether other security forces were involved.

On Saturday, about 2,000 people gathered outside the barracks. A man with a loudspeaker told soldiers separated from protesters by razor wire not to open fire.

Thousands more Islamists braved the fierce midday sun at a sit-in outside a nearby mosque. Shawled women shook their heads and wept as an imam led prayers for "martyrs" of the violence.

At least 15 tanks were positioned on streets leading to the square outside the mosque, but they were farther away than on Friday, suggesting that the military was keen to ease tensions.

According to?Bloomberg, Time Warner?s L.A. sports network has pitched a TV show to Howard in hopes of keeping him around, while the Lakers have billboards all over L.A. to try and retaining Howard?s services. These companies would win big in local markets, but Comcast would see an ever larger rise in revenue from a Howard deal with Houston from potential contracts with satellite TV operators.

Both?Dish Network Corp.?(NASDAQ:DISH) and?DirecTV Group Inc.?(NASDAQ:DTV) are expected to add Comcast?s Houston station to its sports offerings should Howard go to the Rockets.?Bloomberg?estimates Comcast could get between $3 and $3.50 per subscriber for a deal with Dish and DirecTV over Houston Rockets coverage.

The mercurial Howard, who is often the subject of controversy and trade speculation, has yet to hint at his favored destination.?NBA.com?reported Friday that the Golden State Warriors are another team seeking a deal with Howard. The Warriors, whose sports network is also owned by Comcast, were reportedly increasing financial flexibility in order to sweeten their offer to the big man.

The Warriors? Comcast channel already has a deal in place with pay-TV companies, making the company?s benefits available chiefly in the northern California market, where the Warriors are based.

'I'm not frightened of it' Sir Michael Parkinson reveals he has prostate cancer

The former talk show host, who won legions of fans interviewing such greats as Muhammad Ali, Richard Burton and Emu, was diagnosed in May.

But the 78-year-old said he is confident of beating the disease and returning to full health.

He said: "It was a great shock, but I have been told to expect to make a full recovery.

"I had to start calling a few of my social engagements to tell them I couldn't do it - what do you say to them?

"When you are told you have something like cancer, it is a shock.

"But the cancer specialist said: 'I will assure you, you will not die of this.'

"I am concerned about it, of course, but I am not frightened of it."

Sir Michael is currently undergoing radiotherapy five times a week, and said he found the process free from pain and discomfort.

"If anything, it's boring.

"You have to lie there completely still, for six minutes.

"But I have had no side effects at all."

Sir Michael said the cancer is contained to his prostate, and that he should be "completely free" of the disease by August.

And he urged men to pay greater attention to their health in order to catch potential diseases early - with a simple test to check for prostate cancer.

"The test is if you can pee against a wall from 2ft, you haven't got it," he said.

"I don't want to trivialise it, but men know when there's a problem.

"I have been lucky, but men are silly about their health.

"Get it checked out - it might be something else."

Sir Michael's said he had no intention of letting cancer get in the way of his life.

"I'm 78 and I have had a good life," he said.

"When you get involved in this, you begin to understand the extraordinary work of those involved in treating cancer.

"You just sit and look at them in wonder. They do the most extraordinary things, and I am very grateful.

"I shall be around for a while yet, to the delight of my friends and the dismay of my enemies."

Plane crashes while landing at California airport

SAN FRANCISCO ? An Asiana Airlines flight from Seoul, South Korea, crashed while landing at San Francisco International Airport on Saturday, forcing passengers to jump down the emergency inflatable slides to safety. It was not immediately known whether there were any injuries.

Federal Aviation Administration spokeswoman Laura Brown said Flight 214 crashed while landing on runway 28 left at 11:26 PDT.

A video clip posted to YouTube showed smoke coming from a jet on the tarmac. Passengers could be seen jumping down the emergency slides.

Television footage showed the top of the fuselage was burned away and the entire tail was gone. One engine appeared to have broken away. Pieces of the tail were strewn about the runway. Emergency responders could be seen walking inside the burned-out wreckage.

Stephanie Turner saw the plane going down and the rescue slides deploy, but returned to her hotel room before seeing any passengers get off the jet, she told ABC News. Turner said when she first saw the flight she noticed right away that the angle of its approach seemed strange.

?It didn't manage to straighten out before hitting the runway,? she said. ?So the tail of the plane hit the runway, and it cartwheeled and spun and the tail broke off ... I mean we were sure that we had just seen a lot of people die. It was awful.

?And it looked like the plane had completely broken apart,? she said. ?There were flames and smoke just billowing.?

A call to the airline seeking comment wasn't immediately returned.
The National Transportation Safety Board said it was sending a team of investigators to San Francisco to probe the crash. NTSB spokeswoman Kelly Nantel said Saturday that NTSB Chairman Deborah Hersman would head the team.

Asiana is a South Korean airline, second in size to national carrier Korean Air. It has recently tried to expand its presence in the United States, and joined the oneWorld alliance, anchored by American Airlines and British Airways.

The 777-200 is a long-range plane from Boeing. The twin-engine aircraft is one of the world's most popular long-distance planes, often used for flights of 12 hours or more, from one continent to another. The airline's website says its 777s can carry between 246 to 300 passengers.

The flight was 10 hours and 23 minutes, according to FlightAware, a flight tracking service. The aircraft is configured to seat 295 passengers, it said.

The last time a large U.S. airline lost a plane in a fatal crash was an American Airlines Airbus A300 taking off from John F. Kennedy International Airport in New York in 2001.

Smaller airlines have had crashes since then. The last fatal U.S. crash was a Continental Express flight operated by Colgan Air, which crashed into a house near Buffalo, N.Y. on Feb. 12, 2009. The crash killed all 49 people on board and one man in a house.

Samsung's estimated Q2 2013 profits top out at $8.33 billion

Right on schedule, Samsung has released its earnings estimates for Q2 2013 ahead of its full announcement later this month. And, as you might expect, the company made a lot of money: a tidy profit of 9.5 trillion won, or $8.33 billion dollars, to be exact. Naturally, that record-setting number is due in no small part to the success of the Galaxy S 4 and a strong showing by its components division as well. Should the estimate prove perfectly accurate, Q2 2013 will have been a significant improvement over last quarter's $6.4 billion profit, and a massive $3 billion improvement over Q2 of 2012. Of course, we'll get to see its full slate of numbers come July 26th when the financials are officially revealed, but it's looking like Sammy's doing just fine.

Nokia's Here Maps service comes to the Asha 501, beta release available now for download

The touchscreen Asha 501 Nokia unveiled back in May will now work with Here Maps, the company announced on its blog today. The navigation service is already available on Windows Phone 8, Firefox OS, Android and iOS, and its arrival on the Asha platform will boost that operating system's more modest selection of apps. Available now as a beta release, Here Maps for the Asha 501 offers turn-by-turn navigation and real-time traffic information. It's designed specifically for low-end smartphones without GPS on board, and Nokia's post notes that the current version "is a starting point and we will improve the experience over time." Upcoming changes will likely include improved satellite images, which the company says will soon be updated to a higher quality. Asha 501 users in select countries can nab the Here Maps beta via the source link below.

Health App Maker Azumio Launches Argus, A Comprehensive Food And Activity Tracker

Azumio, the maker of health apps, such as Fitness Buddy and Instant Heart Rate, has another one up its sleeve.?The Palo Alto-based startup, which is backed by Founders Fund, Accel and Felicis, is out with a comprehensive activity and food-tracking app called Argus. Argus follows how much you move, walk, run or cycle through the accelerometer; it does not rely on signals from cell towers like other competing apps which might drain the battery more.?It also helps you log what you eat, how you sleep, how much water and coffee you drink and how much you exercise. The idea is that it's a catch-all, life-logging app where people can store all of their activity, eating and sleeping habits in one place without having to switch from app to app. It was a common request from Azumio's user base, the company's CEO?Bojan Bostjancic says.

Key Egyptian negotiator with IMF quits

CAIRO (Reuters) - A key Egyptian negotiator with the International Monetary Fund said on Sunday he has resigned as first deputy finance minister, in a potential blow to Cairo's prospects of an early IMF deal.

Hany Kadry Dimian has been the crucial point man in Egypt's protracted and so far fruitless negotiations to obtain a $4.8 billion loan needed to help combat a severe economic crisis.

"The only comment I can make for the time being is that yes, my term ends on April 30 according to my resignation, which I submitted in December," Kadry told Reuters by telephone.

"My next move is not decided."

A senior technocrat appointed in 2007, Kadry survived five finance ministers in office since the 2011 uprising that overthrew former autocratic President Hosni Mubarak.

Kadry gave no explanation for his decision to quit, first reported on the Egyptian dissident Rebel Economy blog, saying he would say more on Tuesday.

A senior European diplomat said his departure was not a good omen for Egypt's hopes of wrapping up a deal on the long delayed IMF loan next month, as the government has said it aims to do.

Kadry was the one expert in the ministry who fully understood the IMF program and was able to deal with the global lender professionally, the diplomat said.

The daily El-Watan said on its website that Kadry had been under increasing pressure from the ruling Muslim Brotherhood's Freedom and Justice Party, and in conflict with Abdallah Shehata, the FJP economic adviser to Finance Minister Al-Mursi Al-Sayed Hegazy.

Separately, the head of Egypt's bourse, Mohamed Omran, told Prime Minister Hisham Kandil he would like to leave his position at the end of his term on July 1, the state news agency MENA reported, citing an unnamed official stock exchange source.

The report did not give a reason for Omran's request, but said he had told the prime minister in August he wanted to leave the post. Kandil had asked him to stay until the end of his term, MENA said.
